Safety training regulations for production and business units (2015年）
Chapter I General provisions
Article one Strengthen and standardize the safety training work of production and business units, improve the safety quality of employees, prevent casualties and accidents, reduce occupational hazards, and formulate these Provisions in accordance with the Production Safety Law and relevant laws and administrative regulations。
Article 2 Industrial, mining and commercial production and management units(Hereinafter referred to as production and business units) These Provisions shall apply to the safety training of employees。
Article 3 Production and business units shall be responsible for the safety training of their employees。
Production and business units shall, in accordance with the Production Safety Law and relevant laws, administrative regulations and these provisions, establish and improve the safety training system。
Article 4 Production and business units shall conduct safety training for the employees, including the principal person in charge, safety management personnel, special operations personnel and other employees。
Where a production or business unit uses dispatched workers, it shall bring the dispatched workers under the unified management of its employees, and educate and train the dispatched workers on post safe operation rules and safe operation skills。The labor dispatch unit shall provide the dispatched workers with necessary education and training on production safety。
Where a production or business operation unit accepts students from secondary vocational schools or institutions of higher learning for practice, it shall give corresponding education and training on production safety to the students for practice and provide necessary articles of labor protection。Schools shall assist production and business units in providing education and training on production safety to students in practice。
The employees of the production and business units shall receive safety training, be familiar with the relevant production safety rules and regulations and safety operation procedures, have the necessary knowledge of production safety, master the safe operation skills of the position, understand the emergency handling measures of accidents, and know their rights and obligations in production safety。
Employees without qualified safety training shall not be allowed to work。
Article 5 The State Administration of Work Safety shall guide the work of safety training throughout the country and supervise and administer the work of safety training throughout the country according to law。
The relevant competent departments under The State Council shall, in accordance with their respective duties, guide and supervise the safety training work of the industry, and formulate implementation measures in accordance with these Provisions。

Production safety supervision and administration departments at all levels and coal mine safety supervision agencies (hereinafter referred to as production safety supervision and supervision departments) shall, in accordance with their respective duties, supervise and administer the safety training work of production and business units according to law。
The second chapter is the safety training of the main responsible person and the management personnel of production safety
Article 6 The principal person in charge of the production and business operation unit and the personnel in charge of production safety management shall receive safety training and have the knowledge and management ability of production safety that is suitable for the production and business operation they engage in。
Article 7 The safety training for the principal person in charge of the production and business unit shall include the following contents:
(1) the national guidelines and policies on production safety and the laws, regulations, rules and standards related to production safety;
(2) Basic knowledge of production safety management, production safety technology, and professional knowledge of production safety;
（三）Major hazardRelevant provisions on management, prevention of major accidents, emergency management and rescue organizations, and investigation and handling of accidents;
(4) Occupational hazards and their preventive measures;
(5) advanced production safety management experience at home and abroad;
(6) Analysis of typical accidents and emergency rescue cases;
(7) Other content requiring training。
Article VIII Safety training for safety management personnel of production and business units shall include the following contents:
(1) the national guidelines and policies on production safety and the laws, regulations, rules and standards related to production safety;
(2) safe production management, safe production technology, occupational health and other knowledge;
(C) casualty statistics, reports and methods of investigation and treatment of occupational hazards;
(4) Contents and requirements of emergency management, preparation of emergency plans and emergency handling;
(5) advanced production safety management experience at home and abroad;
(6) Analysis of typical accidents and emergency rescue cases;
(7) Other content requiring training。
The ninth article The time of initial safety training for the principal person in charge of the production and operation unit and the safety management personnel shall not be less than32学时。The annual retraining time shall not be less than12学时。
The time of initial safety training shall not be less than that of the principal persons in charge of the production and operation units of coal mines, non-coal mines, hazardous chemicals, fireworks and firecrackers, metal smelting and other production and safety management personnel48Class hours, retraining time per year shall not be less than16学时。
Article ten The safety training of the principal person in charge of the production and business unit and the safety management personnel must be carried out in accordance with the safety training outline formulated by the safety supervision and supervision department。
The safety training program and assessment standards for the main responsible persons and safety management personnel of non-coal mines, hazardous chemicals, fireworks, metal smelting and other production and business units shall be formulated by the State Administration of Work Safety Supervision and Administration。
The safety training program and assessment standards for the main responsible persons and safety management personnel in coal mines shall be formulated by the State Administration of Coal Mine Safety。
Safety training programs and assessment standards for the principal persons and safety management personnel of production and business units other than coal mines, non-coal mines, hazardous chemicals, fireworks and firecrackers, and metal smelting shall be formulated by the departments of production safety supervision and administration of provinces, autonomous regions and municipalities directly under the Central Government。
Chapter III Safety training for other practitioners
Article 11 Coal mines, non-coal mines, hazardous chemicals, fireworks, metal smelting and other production and business units must provide mandatory safety training to newly hired temporary workers, contract workers, laborers, rotation workers, and negotiated workers，Ensure that they have the knowledge and skills required for safe operation, self-rescue, mutual rescue and emergency response，Only then can you arrange the work on duty。
Article 12 Other employees of processing, manufacturing and other production units must undergo safety training and education at three levels before taking up their posts: factory (mine), workshop (section, district, team), and team。
The production and business units shall, in accordance with the nature of the work, provide safety training to other employees to ensure that they have the knowledge and skills of safe operation and emergency handling of the post。
Article 13 The time of pre-job safety training for new employees of production and business units shall not be less than24学时。
The safety training time for newly appointed employees of coal mines, non-coal mines, hazardous chemicals, fireworks, metal smelting and other production and business units shall not be less than72Class hours, retraining time per year shall not be less than20学时。
Article 14 Plant (mine) level pre-job safety training content should include:
(1) the safety production situation of the unit and the basic knowledge of safety production;
(2) production safety rules and regulations and labor discipline of the unit;
(3) the rights and obligations of employees in production safety;
(4) Relevant accident cases, etc。
Coal mine, non-coal mine, hazardous chemicals, fireworks, metal smelting and other production and business units (mine) level safety training in addition to the above content, should increase the accident emergency rescue, accident emergency plan drills and preventive measures。
Article 15 Workshop (section, district, team) level pre-job safety training content should include:
(1) Working environment and risk factors;
(2) Occupational injuries and casualties that may be suffered by the type of work they are engaged in;
(3) the safety responsibilities, operational skills and mandatory standards of the types of work engaged;
(4) self-rescue and mutual rescue, first aid methods, evacuation and on-site emergency treatment;
(5) The use and maintenance of safety equipment and facilities and personal protective equipment;
(vi) the workshop (section, district, team) safety production status and rules and regulations;
(7) Measures to prevent accidents and occupational hazards and safety matters to be noted;
(8) cases of relevant accidents;
(9) Other content requiring training。
Article 16 The content of pre-job safety training at the team level shall include:
(A) post safety operation procedures;
(2) Safety and occupational health matters related to the coordination of work between posts;
(3) cases of relevant accidents;
(4) Other content requiring training。
Article 17 When employees adjust their jobs in the production and business units or leave their posts for more than one year to resume their posts, they shall receive safety training at the workshop (section, district, team) and team level。
When a production or business entity implements a new process, new technology or uses new equipment or new materials, it shall re-conduct targeted safety training for the relevant employees。
Article 18 The special operation personnel of the production and business operation unit must receive special safety training in accordance with the relevant laws and regulations of the State, and can only take up the post after passing the examination and obtaining the special operation qualification certificate。
The scope of special operation personnel and the training and assessment management measures shall be stipulated separately。
Chapter IV Organization and implementation of safety training
Article 19 Safety training for employees of production and business units shall be organized and implemented by production and business units。
Production and business units shall insist on promoting learning through examination and teaching, and ensure that all employees are proficient in the knowledge and skills of workplace safety;Coal mines, non-coal mines, hazardous chemicals, fireworks, metal smelting and other production and business units should also improve and implement the master apprentice system。
Article 20 Production and business units that have the conditions for safety training shall give priority to independent training;Institutions with safety training conditions may be entrusted to conduct safety training for employees。
Production and business units that do not have the conditions for safety training shall entrust institutions that have the conditions for safety training to conduct safety training for employees。
Where a production or business unit entrusts other institutions to conduct safety training, the responsibility for ensuring safety training remains with the unit。
Article 21 Production and business units shall incorporate safety training into their annual work plans。Ensure the funds needed for the safety training work of the unit。
The main person in charge of the production and business unit is responsible for organizing the formulation and implementation of the safety training plan of the unit。
Article 22 The production and business units shall establish and improve the safety production education and training files of employees, and the production and business units' safety production management institutions and safety production management personnel shall record the training time, content, participants and assessment results in detail and accurately。
Article 23 Production and business units shall pay wages and necessary expenses during the period when they arrange employees to undergo safety training。
Chapter V Supervision and administration
Article 24 The principal persons in charge of the production and business operations of coal mines, non-coal mines, hazardous chemicals, fireworks and firecrackers, metal smelting and other production and safety management personnel, as of the date of taking office6Within a month, the production safety supervision and supervision department must pass the examination of its production safety knowledge and management ability。
Article 25 Production safety supervision and supervision departments shall supervise and inspect the safety training of production and business units according to law, and urge production and business units to carry out safety training in accordance with relevant state laws and regulations and these provisions。
The departments responsible for the supervision and administration of coal mine production safety under the local people's governments at or above the county level shall supervise and inspect the safety training of underground coal mine operators。The coal mine safety supervision institution shall supervise and inspect the safety training of special operation personnel in coal mines and their postings with certificates。
Article 26 Production safety supervision and supervision departments at all levels shall supervise and inspect the safety training of production and business units and the situation of holding certificates to work, mainly including the following contents:
(1) The development and implementation of safety training systems and plans;
(b) coal mines, non-coal mines, hazardous chemicals, fireworks, metal smelting and other production and business units in charge of safety management personnel safety training and safety production knowledge and management ability assessment;The training of main responsible persons and safety management personnel of other production and business units;
(3) The situation of special operation personnel holding the operation qualification certificate to work;
(4) Establish production safety education and training files, and truthfully record the situation;
(5) On-site sampling of employees' work safety knowledge;
(6) Other contents that need to be checked。
Article 27 The work safety supervision and supervision departments shall strictly assess the main responsible persons and safety management personnel of production and business units such as coal mines, non-coal mines, hazardous chemicals, fireworks and firecrackers, and metal smelting in accordance with these provisions。No charge for assessment。
The relevant personnel in charge of assessment by the production safety supervision and supervision departments shall not neglect their duties and abuse their power。
Article 28 Production safety supervision and supervision departments found in the inspection of production safety education and training responsibilities are not in place, the relevant practitioners without qualified training, shall be regarded as a hidden danger of production safety accidents, ordered production and business units immediately stop illegal acts, rectification within a time limit, and be punished according to law。
Chapter VI Rules of punishment
Article 29 Where a production or business entity commits any of the following acts, it shall be ordered by the supervision and supervision department of production safety to make corrections within a time limit and may be punished1More than 10,000 yuan3Fines of less than RMB 10,000:
(A) does not include the safety training work into the work plan of the unit and ensure the funds needed for safety training work;
(2) Employees do not pay wages and bear safety training expenses during the safety training。
Article 30 Where a production or business entity commits any of the following acts, it shall be ordered by the supervision and supervision department of production safety to make corrections within a time limit and may be punished5A fine of less than RMB 10,000 yuan;Those who fail to make corrections within the time limit shall be ordered to suspend production and business for rectification and concurrently5More than 10,000 yuan10A fine of not more than RMB yuan shall be imposed on the persons directly in charge and other persons directly responsible1More than 10,000 yuan2Fines of less than RMB 10,000:
(A) coal mines, non-coal mines, hazardous chemicals, fireworks and firecrackers, metal smelting and other production and business units of the main person in charge and safety management personnel failed to pass the examination in accordance with the provisions;
(2) failing to conduct education and training on production safety for employees, dispatched workers and intern students or failing to truthfully inform them of matters related to production safety;
(3) failing to truthfully record production safety education and training;
(4) The special operators have not received special safety technical training and obtained the special operators operation qualification certificate in accordance with the provisions of the special operators to work。
Where the department responsible for the supervision and administration of coal mine production safety under the local people's government at or above the county level finds that a coal mine has not provided safety training to underground operators in accordance with these provisions, it shall order it to make corrections within a time limit and be punished10More than 10,000 yuan50A fine of less than RMB 10,000 yuan;Those who fail to make corrections within the time limit shall be ordered to suspend production and business for rectification。
Where the coal mine safety supervision institution finds that the coal mine special operators work without licenses, it shall order them to make corrections within a time limit and punish them10More than 10,000 yuan50A fine of less than RMB 10,000 yuan;Those who fail to make corrections within the time limit shall be ordered to suspend production and business for rectification。
Article 31 If the relevant personnel of the supervision and supervision department of production safety neglect their duties or abuse their power in the assessment and certification work, the superior supervision and supervision department of production safety or the administrative supervision department shall give an administrative sanction of demerit or major demerit。
Chapter VII Supplementary Provisions
Article 32 The principal person in charge of a production or business unit refers to the chairman and general manager of a limited liability company or a joint stock limited company, and the factory director, manager, director (including the actual controller) of other production or business units。
Safety production management personnel of production and business units refer to the person in charge of safety production in production and business units, the person in charge of safety production management organization and its management personnel, as well as the professional and part-time safety production management personnel of production and business units without safety production management organization。
Other employees of a production and business unit refer to all the personnel engaged in production and business activities of the unit, including other responsible persons, other managerial personnel, technical personnel, workers of various positions and temporary personnel, except the principal person in charge, the administrative personnel of production safety and the special operation personnel。
Article 33 The departments of work safety supervision and administration of provinces, autonomous regions and municipalities directly under the Central Government and the provincial coal mine safety supervision agencies may formulate implementation rules in accordance with these Provisions and report them to the State Administration of Work Safety Supervision and Administration and the State Administration of Coal mine Safety for the record。
