Act 1 总 则
Article one These Provisions are formulated in accordance with relevant laws and administrative regulations such as the Production Safety Law and the Administrative License Law in order to standardize the safety technical training and assessment of special operators, improve the safety technical level of special operators, and prevent and reduce casualties and accidents。
Article 2 These Provisions shall apply to the safety technical training, assessment, certification, review and supervision and administration of special operation personnel of production and business units。
Where there are other provisions in relevant laws, administrative regulations and The State Council on the management of special operators, such provisions shall prevail。
Article 3 The term "special operations" as mentioned in these Provisions refers to the operations that are prone to accidents and may cause significant harm to the safety and health of the operators themselves and others, as well as the safety of equipment and facilities。The scope of special operations shall be defined by the special operations catalogue。
The term "special operators" as mentioned in these Provisions refers to the employees directly engaged in special operations。
Article 4 Special operators shall meet the following conditions:
(1) The age attained18One year old, and not more than the state retirement age;
(2) have passed the physical examination by a medical institution at or above the county level, and have no organic heart disease, epilepsy, Meniere's disease, vertigo, hysteria, palsy tremor, mental illness, dementia, and other diseases and physiological defects that prevent them from engaging in corresponding special operations;
(3) having a junior high school education or above;
(4) Having the necessary safety technical knowledge and skills;
(5) Other conditions specified in corresponding special operations。
In addition to meeting the conditions stipulated in items (1), (2), (4) and (5) of the preceding paragraph, the personnel engaged in special operations of hazardous chemicals shall have a high school education or equivalent to high school education or above。
Article 5 Special operators must pass special safety technical training and assessment, and obtain the Special Operation Certificate of the People's Republic of China (hereinafter referred to as the Special Operation Certificate) before taking up the post。
Article 6 The safety technical training, assessment, certification and review of special operators shall be carried out under the principles of unified supervision, multi-level implementation and separation of teaching and examination。
Article 7 The State Administration of Work Safety (hereinafter referred to as the State Administration of Work Safety) directs and supervises the training, assessment, certification and review of safety technology for special operators throughout the country;The work safety supervision and administration departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall guide and supervise the safety technical training of special operators in their respective administrative areas，To be responsible for the assessment, certification and review of special operators in their respective administrative areas;The production safety supervision and administration departments of the local people's governments at or above the county level shall be responsible for supervising and inspecting the safety technical training of special operators in their respective administrative areas and their work with certificates。
The State Administration of Coal Mine Safety Administration (hereinafter referred to as the Administration of Coal mine Safety Administration) directs and supervises the training, assessment, certification and review of safety techniques for special coal mine operators (including operators of special equipment used in coal mines) throughout the country;The departments or designated agencies of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government responsible for the examination and certification of special coal mine operators shall guide and supervise the safety technical training of special coal mine operators in their respective administrative areas，To be responsible for the examination, certification and review of special operators of coal mines in their respective administrative areas。
The departments of production safety supervision and administration of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the departments responsible for the examination and certification of special operators in coal mines or the designated institutions (hereinafter referred to as the examination and certification authorities) may entrust the departments of production safety supervision and administration of the people's governments of cities divided into districts and the departments responsible for the examination and certification of special operators in coal mines or the designated institutions to implement special operatorsExamination, certification and review work。
Article VIII Training, assessment, certification and review of illegal acts of special operators in safety technology，Any unit or individual has the right to report to the General Administration of Safety Supervision, the Coal mine Safety Administration, the work safety supervision and administration department of the people's government of provinces, autonomous regions, municipalities directly under the central government and cities divided into districts, the department responsible for the examination and certification of special operators in coal mines or the designated agency。
Chapter Two Training
The ninth article Special operators shall receive theoretical training on safety technology and practical operation training corresponding to the special operations they engage in。
Graduates who have obtained vocational high school, technical school or technical secondary school or above are engaged in special operations corresponding to their major, and with the approval of the examination and certification authority, they may be exempted from training in related majors。
Special operators who work across provinces, autonomous regions and municipalities directly under the Central Government may participate in training at the place where they have their household registration or where they work。
Article ten For the safety technical training of special operation personnel, the production and business units with safety training conditions shall give priority to independent training, and can also entrust institutions with safety training conditions to conduct training。
Production and business units that do not have the conditions for safety training shall entrust institutions that have the conditions for safety training to conduct training。
Where a production or business unit entrusts other institutions to conduct safety technical training for special operation personnel, the responsibility for ensuring safety technical training shall remain with the unit。
Article 11 Institutions engaged in safety technology training for special operation personnel (hereinafter referred to as training institutions)，Corresponding training plans and teaching arrangements shall be formulated，And in accordance with the General Administration of Safety supervision, coal mine safety supervision bureau formulated special operators training program and coal mine special operators training program for special operators safety technology training。
Chapter III Examination and certification
Article 12 The examination of special operators includes two parts: examination and audit。The examination shall be the responsibility of the examination and certification authorities or the units entrusted by them.The examination and approval authorities shall be responsible for the examination and certification。
The State Administration of Safety Supervision and the Bureau of Coal mine Safety Supervision have respectively formulated the assessment standards for special operators and coal mine special operators, and established corresponding examination question banks。
Examination and certification organs or their entrusted units shall be in accordance with the State Administration of safety supervision, coal mine safety supervision bureau unified assessment standards。
Article 13 The personnel who participate in the special operation qualification examination shall fill in the examination application form, and the applicant or the applicant's employing unit shall submit an application to the examination and certification authority or the unit entrusted by the applicant with the educational certificate or the training certificate issued by the training institution in the place of the applicant's household registration or employment。
After receiving the application, the examination and certification authority or the unit entrusted by it shall submit the application60Intraday test。
The special operation qualification examination includes two parts: safety technology theory examination and practical operation examination。Those who fail the exam are allowed to take a make-up exam1次。Those who still fail to pass the make-up examination shall participate in the corresponding safety technical training again。
Article 14 The units entrusted by the examination and certification authorities to undertake the special operation qualification examination shall have the corresponding places, facilities, equipment and other conditions, establish the corresponding management system, and publish the information such as charging standards。
Article 15 The examination and certification authority or the unit entrusted by it to undertake the special operation qualification examination shall be completed after the examination10Test results will be released within working days。
Article 16 The special operators who meet the provisions of Article 4 of these provisions and pass the examination shall apply for the special operation certificate to the examination and certification authorities of the place where their household registration is located or the place where they work, and submit the copy of their ID card, the copy of their academic certificate, the physical examination certificate, the examination certificate and other materials。
Article 17 The examination and certification authorities that have received the application shall5Complete the examination of the application materials submitted by the special operators within working days, and make a decision on acceptance or rejection。If an acceptance decision can be made on the spot, it shall be made on the spot;If the application materials are not complete or do not meet the requirements, they shall be on the spot or in person5Notify the applicant of all the contents to be corrected within one working day, and fail to notify the applicant within the time limit, shall be deemed to have been accepted since the date of receipt of the application materials。
Article 18 For the applications that have been accepted, the examination and certification authorities shall20Complete the audit within working days。If the conditions are met, the special operation certificate shall be issued;If the conditions are not met, reasons shall be given。
Article 19 The special operation certificate is valid for6It was effective nationwide。
The special operation certificate shall be unified in style, standard and number by the General Administration of Safety Supervision。
Article 20 If the special operation certificate is lost, a written application shall be submitted to the original examination and license-issuing authority, which shall be reissued after examination and approval by the original examination and license-issuing authority。
If the information recorded in the special operation certificate is changed or damaged, a written application shall be submitted to the original examination and license issuing authority, which shall be replaced or updated after examination and confirmation by the original examination and license issuing authority。
Chapter IV Retrial
Article 21 Special operation certificate3Annual review1次。
The special operation personnel shall continue to engage in this type of work within the validity period of the special operation operation certificate10More than a year, strictly abide by the relevant laws and regulations of production safety, with the consent of the original examination and certification authority or the local examination and certification authority, the review time of special operation certificate can be extended to every6年1次。
Article 22 Where the special operation certificate needs to be reviewed, it shall be reviewed before its expiration60Within days, the applicant or the applicant's employer shall submit an application to the original examination and license issuing authority or the examination and license issuing authority in the place where the employment is located, and submit the following materials:
(1) A health certificate issued by a community or medical institution at or above the county level;
(2) the situation of engaging in special operations;
(3) Safety training and examination passing records。
If the special operation certificate needs to be extended to renew after the expiration of its validity period, it shall apply for an extended review in accordance with the provisions of the preceding paragraph。
Article 23 Before applying for the review or extension of the review of the special operation certificate, the special operation personnel shall participate in the necessary safety training and pass the examination。
Safety training time is not less than8Each class hour, the main training laws, regulations, standards, accident cases and related new technology, new technology, new equipment and other knowledge。
Article 24 Where an application for reexamination is made, the examination and license-issuing authority shall, from the date of receipt of the application20Complete the review within working days。If it passes the examination, it shall be signed and registered by the examination and license-issuing authority for confirmation;If you fail, explain the reason。
If the applicant applies for a deferred review, after passing the review, the examination and license issuing authority shall issue a new special operation certificate。
Article 25 Special operators have any of the following circumstances, review or deferred review shall not pass:
(1) failing the physical examination;
(2) Serious consequences of illegal operations or2Violating regulations for more than one time, and verified to be true;
(3) where there are violations of production safety and administrative penalties are imposed;
(4) refusing or obstructing the supervision and inspection of production safety supervision departments;
(5) failing to participate in safety training as required, or failing to pass the examination;
(6) in the circumstances provided for in Articles 30 and 31 of these Provisions。
Article 26 Special operation certificate review or delayed review in accordance with the provisions of Article 25 (2), (3), (4), (5) of the circumstances, in accordance with the provisions of the re-safety training examination after passing, then go through the review or delayed review procedures。
Re-review, delayed review still fails, or fails to review on time, the special operation certificate is invalid。
Article 27 Where the applicant has objections to the review or the extension of the review, he may apply for administrative reconsideration or bring an administrative lawsuit in accordance with law。
Chapter V Supervision and administration
Article 28 The examination and certification authorities or the units entrusted by them and their staff shall be loyal to their duties, adhere to principles, be honest and self-disciplined, conduct the examination, certification and review of special operators in accordance with the provisions of laws, regulations and rules, and accept social supervision。
Article 29 Examination and certification organs shall strengthen the supervision and inspection of special operators，Where it is found to have any of the circumstances provided for in Article 30 of these Provisions，Timely cancellation of special operation certificate;For violations of production safety that should be subject to administrative penalties according to law，Administrative penalties shall be imposed on production and business units and their special operators in accordance with relevant regulations。
Examination and certification organs shall establish a special operation personnel management information system to facilitate the employer and the public to inquire;For the special operation personnel who cancel the special operation certificate, it shall be announced to the public in a timely manner。
Article 30 Under any of the following circumstances, the examination and certification authority shall revoke the special operation certificate:
(1) Exceeding the validity period of the special operation certificate and not extending the review;
(2) The physical conditions of the special operators are no longer suitable for continuing to engage in special operations;
(3) being responsible for the occurrence of production safety accidents;
(4) The special operation certificate records false information;
(5) Obtaining special operation certificates by cheating, bribery and other improper means。
Where special operators violate the provisions of items (4) and (5) of the preceding paragraph,3The special operation certificate shall not be applied for again during the year。
Article 31 Under any of the following circumstances, the examination and certification authority shall cancel the special operation certificate:
(1) The death of a special operator;
(2) Special operators apply for cancellation;
(3) The special operation certificate is revoked according to law。
Article 32 Leave specialty jobs6Special operation personnel who have been more than a month shall re-take the practical operation examination and be confirmed as qualified before taking the post。
Article 33 The work safety supervision and administration departments of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the departments responsible for the examination and certification of special operators in coal mines or the designated agencies shall report the examination and certification of special operators to the State Administration of Safety Supervision and Administration of Coal mine Safety respectively every year。
Article 34 Production and business units shall strengthen the management of their own special operations personnel, establish and improve the training and review files of special operations personnel, and do a good job in the organization of declaration, training, assessment and review and daily inspection work。
Article 35 If a special operator changes his working unit after the expiration of the labor contract, the original working unit shall not detain his special operation certificate for any reason。
Special operators who work across provinces, autonomous regions and municipalities directly under the central government shall accept the supervision and administration of the examination and certification authorities where they work。
Article 36 Production and business units may not print, forge or resell special operation certificates, or use illegally printed, forged or resold special operation certificates。
Special operators shall not forge, alter, lend, transfer or falsely use special operation certificates or use forged special operation certificates。
Chapter VI Rules of punishment
Article 37 Those who abuse their power, neglect their duties or engage in malpractice for personal gain in the assessment, certification and review of special operators or the units entrusted by them and their staff shall be given administrative sanctions according to law;If the case constitutes a crime, criminal responsibility shall be investigated according to law。
Article 38 Where the production or business unit fails to establish and improve the files of the special operators, it shall be given a warning and concurrently1A fine of less than $10,000。
Article 39 Where a production or business entity uses special operation personnel who have not obtained special operation operation certificates to work, it shall be ordered to make corrections within a time limit;admissibility5A fine of less than RMB 10,000 yuan;Those who fail to make corrections within the time limit shall be ordered to suspend production and business for rectification and concurrently5More than 10,000 yuan10A fine of not more than RMB yuan shall be imposed on the persons directly in charge and other persons directly responsible1More than 10,000 yuan2A fine of less than $10,000。
Where a coal mining enterprise uses a special operator who has not obtained a special operation certificate to work, it shall be punished in accordance with the Special Provisions of The State Council on the Prevention of Coal Mine Production Safety Accidents。
Article 40 Where a production or business entity illegally prints, forges or resells special operation certificates, or uses special operation certificates illegally printed, forged or resells, a warning shall be given and concurrently imposed1More than 10,000 yuan3A fine of less than RMB 10,000 yuan;If the case constitutes a crime, criminal responsibility shall be investigated according to law。

Chapter VII Supplementary Provisions

Article 43 The departments of production safety supervision and administration of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the departments responsible for the examination and certification of special operators in coal mines or the designated agencies may formulate implementation rules in light of the actual conditions of their respective regions and report them to the State Administration of Safety Supervision and Administration of Coal mine Safety for the record。
