Rules for the implementation of fireworks and firecrackers business license in Henan Province
Act 1 总则
Article one 为了加强我省Fireworks and firecrackers经营许可管理工作，根据国务院Fireworks安全管理条例》和国家安全生产Supervision and administration总局Fireworks management许可实施办法》In combination with the actual situation of our province, formulate these implementation rules。
Article 2 河南省行政区域内Fireworks and firecrackers的经营，适用本实施细则。
Engaged in fireworks wholesale enterprises(含进出口企业，以下统称批发企业)和从事Fireworks and firecrackers零售的经营者(以下简称零售经营者),必须按照本实施细则的规定申请取得Fireworks and firecrackers经营许可证。
未取Fireworks and firecrackers经营许可证的，不得从事Fireworks and firecrackers经营活动。
Article 3 Fireworks and firecrackers经营许可证的颁发管理，实行分级发证、属地监管的原则。
Article 4 Fireworks business license shall be divided into fireworks business(批发)许可证》和Fireworks management(零售)许可证》。Fireworks management(批发)许可证》有效期为两年，Fireworks management(零售)许可证》有效期最长不得超过一年。
Provincial work safety supervision Administration(以下简称省局)负责全省Fireworks and firecrackers经营许可的Supervision and administration工作；负责全省批发企业经营许可证的颁发管理，也可委托Administration of work Safety under the jurisdiction of provincial cities颁发管理。
Administration of work Safety under the jurisdiction of provincial cities(以下简称省辖市局)负责本辖区内Fireworks and firecrackers经营许可的Supervision and administration工作；负责确定本辖区Fireworks and firecrackers经营单位的总体规划；负责监督、管理本辖区批发企业，对批发企业的安全条件进行审查；负责审批本辖区Fireworks and firecrackers经营(零售)布局方案。
县(市、区)安全生产Supervision and administration局(以下简称县(市、区)局)负责本辖区内Fireworks and firecrackers经营许可的日常Supervision and administration；负责制定本辖区Fireworks and firecrackers零售布点方案；负责本辖区Retail license证的颁发管理工作。
Article 5 各级安全生产Supervision and administration部门应当按照统一规划、合理布局、总量控制、规范管理、经营有序、方便群众、确保安全的原则，严格依照有关法律、法规和标准规定的条件、程序，颁发Fireworks and firecrackers经营许可证。
Fireworks and firecrackers经营单位的数量应当根据上述原则从严控制。
Act 2 Conditions of business license
Article 6 Fireworks wholesale enterprises shall meet the following conditions:
(一)工商营业执照副本或工商行政管理部门核发的《十大网堵平台推荐》。
(二)建立健全安全管理制度和操作规程：;主要负责人、分管负责人、安全管理人员、从业人员岗位安全责任制度，Warehouse safety management system, product flow registration system，Product entry and exit is the inspection and acceptance system，Warehouse security system，Hot work management system，Safety equipment and facilities management system，Hidden danger rectification system，Safety education and training system for employees，Safety input guarantee system，Safety inspection system，Disposal system for nonconforming products and expired products，Monitoring measures for major hazard sources;Warehouse management post operating procedures，Fire safety post operating regulations，Inspection and acceptance of post operating procedures，Safety operating rules for transportation, handling, loading and unloading posts。
(三)设置安全管理机构并配备1—3名专职安全管理人员。
(四)主要负责人、分管负责人、安全管理人员应当具备Fireworks and firecrackers经营方面的安全知识和管理能力，并经省辖市级以上安监部门培训考核合格。
仓库保管员、守护员应当接受Fireworks and firecrackers专业知识培训，并经省辖市级以上安监部门培训考核合格。
其他从业人员应当接受当地安监部门和本单位安全知识教育和培训。
(五)县级以上建设(规划)行政主管部门出具的选址意见书。
(6) Land use certificate of storage place。
(七)具有与经营规模和产品品种相适应的经营场所和储存设施，并符合下列要求：
1、储存仓库不在城市建成区内，且产权明晰、使用合法。
2、储存仓库的内外部安全距离、库房布局、建筑结构、安全疏散条件、消防、防爆、防雷、防静电等安全设施以及电气设施等，符合Fireworks工厂设计安全规范》(GB50161)等国家相关标准的规定。有库区外部安全距离示意(或者实测)图和库区仓储设施平面(或者设计)图。
3. Storage area is separated from office area and living area。
4, storage areas and warehouses should have obvious safety warning signs and identification plates。
5、储存仓库应当张贴安全管理制度和操作规程，库房门前应有标明产品类别、危险等级、总存量和保管人员的标识牌。
(八)具备配送服务能力，配送车辆符合国家相关标准。用于生产Fireworks and firecrackers的黑火药、烟火药、引火线等批发企业，还必须自有危险物品运输车辆和相关资质，具备必要的安全保管技术措施和配送服务能力。
(九)制定有完善的事故应急救组织，配备有人员、应急救援器材和设备。
(十)设立批准文件和安全Design review备案书、验收意见书。
(11) Documents certifying the payment of industrial injury insurance premiums by employees。
(十二)依法进行了安全评价，且《十大网赌平台推荐》综合评价结论为“符合安全经营条件"。
(13) Other conditions stipulated by laws and regulations。
Article 7 Retail operators of fireworks and firecrackers shall meet the following conditions:
(一)负责人和销售人员经过当地安监部门安全知识培训。
(二)实行专店或者专柜、专人销售，设专人负责安全管理。专柜销售时，专柜应当相对独立，并与其他柜台保持一定的距离，保证安全通道畅通。
(三)零售场所的面积不小于10平方米，周边50米范围内没有其他Fireworks and firecrackers零售点；周边100米范围内没有加油站等易燃易爆生产、储存设施和经营网点；周边50米范围内没有学校、幼儿园、医院等人员聚集场所。
(四)零售场所应当配备必要的消防器材，并张贴明显的安全警示标志。
(五)法律、法规以及当地人民政府规定的其他条件。
Act 3 Wholesale license
Section 1 Approval of establishment
Article VIII The establishment of wholesale business enterprises and existing wholesale business enterprises newThe project of warehouse construction (alteration or expansion) must be submitted to the provincial bureau for approval。
The ninth article The establishment of a wholesale business enterprise shall comply with the following provisions:
(A) in line with the local fireworks operation overall plan。
(二)企业法人营业执照或工商部门核发的《十大网堵平台推荐》。
(三)主要负责人应当具备高中以上文化程度，年龄不得超过60岁。
(4) Establish an independent operation and storage plan。
Article ten New construction, reconstruction and expansion projects shall comply with the following provisions:
(A) in line with the local fireworks operation overall plan。
(二)建设项目不得在城市规划区内，并有县级以上建设行政主管部门出具的选址意见书。
(3) There is a land use certificate for the proposed storage site。
(4) There is a plan of the distance of facilities around the proposed storage place。
(五)仓储设施独立建筑面积在300—1000平方米。
Article 11 拟设立的批发公司和现有批发公司新建、改建、扩建仓储设施的，在分别符合The ninth article、Article ten规定后，方可向县(市、区)局提出申请，县(市、区)局审查合格后向省辖市局提出申请，省辖市局审查合格后报省局批准。
The second section Design review
Article 12 经省局批准设立的批发公司和现有批发公司新建、改建、扩建仓储设施的建设项目，应进行Design review并提交下列资料：
(1) Qualification certificate of the design unit。
(二)设计单位设计的施工图纸(附安全设施专篇)。
(3) The internal and external distance plan of the proposed warehouse。
Article 13 The design review shall be organized by the Provincial Bureau or the intermediary agency entrusted by the Provincial Bureau。审查通过的，建设单位持Design review备案书，选择有资质的施工单位施工建设。审查未通过的，设计单位应根据专家审查意见修改后，重新提交审查。
The third segment Acceptance review
Article 14 After completion of the construction project, the construction unit shall report the project to the county separately(city, district) bureaus, provincial bureaus and provincial bureaus shall apply for acceptance inspection。
Article 15 对已受理的验收申请，省局或省局委托有关省辖市局组织验收。The members of the inspection organization shall be provincial bureaus, provincial bureaus and counties(市、区)局工作人员和有关专家组成，专家组成员一般不少于3人。
Article 16 Acceptance inspectors shall review and verify the following:
(一)省、市、县(市、区)安监部门有关批准文件及企业申报材料原件。
(二)各种安全责任制度、操作规程、应急救援预案、配送服务能力及工伤保险证明原件。
(3) The original qualification certificate of the relevant personnel。
(4) Qualification certificate and construction quality report of the construction unit。
(五)仓储设施条件，内、外部安全距离，防雷、防静电、消防及监控等安全设施情况。
(6) Contents of the Safety Acceptance Evaluation Report。
Article 17 Acceptance review组对有关材料和现场审查核实的情况，给出明确的Acceptance review意见，出具Acceptance review意见书。
Article 18 对于Acceptance review中发现有安全隐患、材料错误和缺陷的，Acceptance review组应当向申请单位、评价机构明确指出，待整改完成后分别由评价机构和省辖市局进行核查确认。
第十九条现场Acceptance review合格，符合安全条件的，Acceptance review组出具结论性验收意见。Municipalities and countiesThe (municipal and district) bureaux signed clear opinions respectively。
Fourth quarter Initial application and approval
Article 20 Wholesale enterprises apply for handling of fireworks and firecrackers(批发)许可证》,应当提交下列文件、资料，并对其真实性负责：
(一)Fireworks management(批发)许可证申请书》1式3份。
(2) The contents stipulated in Article 6 of Chapter II。
(3) Review opinions of provincial bureaus and county (city, district) bureaus。
Article 21 Under the following circumstances, bureaus and counties of the cities under the jurisdiction of the provincial government shall be administeredThe (municipal, district) bureau shall not agree to its application for a business license:
(一)存在违反有关安全生产法律、法规的行为，尚未改正的。
(2) A major accident has occurred and is in the period of rectification。
(3) concealing relevant information or providing false certification materials。
(4) those that do not conform to the overall plan for the operation of fireworks and firecrackers in the local area。
Article 22 省局对批发企业提出的申请，应当按照下列规定分别处理：
(一)申请事项不属于本部门职权范围的，应当即时出具Fireworks management(批发)许可证申请不予受理通知书》。
(二)申请材料存在可以当场更正的错误的，应当允许或者要求申请单位当场更正，并即时出具Fireworks management(批发)许可证申请受理通知书》(以下简称《十大网赌平台推荐》)。
(三)申请材料不齐全或者不符合要求的，应当当场或者在5个工作日内向申请单位出具Fireworks management(批发)许可证申请材料补正告知书》,一次告知需要补正的全部内容，逾期不告知的，自收到申请材料之日起即为受理。
(四)申请材料齐全、符合要求或者按照要求全部补正的，自收到申请材料或者全部补正材料之日起为受理，并出具《十大网赌平台推荐》。
Article 23 If a decision is made to issue a business license, the decision shall be made from the date of acceptance30个工作日办理完毕；对决定不予颁发的，应当出具Fireworks management(批发)许可证不予颁发通知书》,在10个工作日内通知申请单位。
Article 24 The time for rectification and correction by the applicant unit is not included in the approval time limit。
The fifth segment Change application and approval
Article 25 Wholesale enterprises in the fireworks business(批发)许可证》有效期内有下列情形之一的，应当在工商营业执照变更后10日内，向省局申请变更经营许可证：
(1) Changing the name of the unit。
(2) The principal person in charge is changed。
(3) Changing the registered address。
(4) Changing the business scope。
Article 26 申请变更经营许可证，应当提交下更文件、资料，并对其真实性负责：
(一)Fireworks management(批发)许可证申请书》1式3份。
(二)原Fireworks management(批发)许可证》正、副本。
(3) a copy of the changed industrial and commercial business license。
(四)申请变更主要负责人的，还应当提供变更后的主要负责人的安全资格证书。
Article 27 对批准变更的，省局收回原经营许可证，换发变更后的经营许可证，原经营许可证编号、有效期不变。
Sixth segment Reapply and approve
Article 28 Has obtained the fireworks business(批发)许可证》的单位有下列情况的，应当重新申请：
(一)批发企业在有效期满后继续从事Fireworks and firecrackers经营的，应当在经营许可证有效期满前3个月重新申请。
(二)新建、改建、扩建储存设施的，应当在竣工验收合格后10日内重新申请。
Article 29 Wholesale enterprises re-apply for the fireworks business(批发)许可证》,应当按照本实施细则Act 3第一节至Fourth quarter的规定办理。
Article 30 After re-issuing the license, the provincial bureau shall recover the original business license。
Act Four Retail license
Article 31 Retail operators apply for handling the Fireworks business(零售)许可证》时，应当提交下列申请材料，并对其真实性负责：
(1) Application for Fireworks Business (Retail) Permit。
(二)营业执照副本或者工商部门核发的《十大网堵平台推荐》。
(3) The business premises shall meet the requirements of the local retail distribution plan。
(4) the property right of the business premises or the use of the lease certificate。
(5) Description of security conditions around retail points。
(六)主要负责人和销售人员经过当地安监部门培训的证明。
(7) Supply agreements signed with local fireworks wholesale enterprises。
(8) Proof of fire control equipment。
(9) Other materials required by the county (city, district) bureau。
Article 32 县(市、区)局受理申请后，应当对申请材料和零售场所的安全条件进行审查核查。Examination and verification personnel shall submit written examination and verification opinions。
Article 33 县(市、区)局应当在受理申请之日起20个工作日内，作出颁发或者不予颁发经营(零售)许可证的决定，并书面告知申请人。对决定不予颁发经营(零售)许可证的，应当书面说明理由。
Article 34 Perennial retail operators of the fireworks business(零售)许可证》有效期为1年，临时零售经营者的Fireworks management(零售)许可证》有效果期，由各省辖市局根据本地实际确定，最长不得超过1年。
Article 35 各省辖市局可参照本实施细则的规定，结合本地实际，制定本行政区域内Fireworks managementAdministrative measures for issuing (Retail) Licenses。
Chapter Five Supervision and administration
Article 36 禁止批发企业在城市建成区内设立Fireworks and firecrackers储存仓库和存有实物的批发场所。
Strictly control the number of fireworks retail outlets in urban areas。
Article 37 批发企业必须从合法的Fireworks and firecrackers生产企业采购Fireworks and firecrackers，向零售经营者供应符合质量标准的Fireworks and firecrackers。不得采购和销售非法生产、经营的Fireworks and firecrackers和不符合质量标准的Fireworks and firecrackers；不得向未获得行政许可的零售经营者销售Fireworks and firecrackers；不得向零售经营者销售按照国家标准规定应当由专业燃放人员燃放的Fireworks and firecrackers。
批发企业应当及时收回零售经营者在许可期满后未销售的Fireworks and firecrackers。
黑火药、烟火药、引火线批发企业不得向未取得Fireworks and firecrackers安全生产许可证的任何单位和个人销售黑火药、烟火药、引火线。
零售经营者不得经营和储存黑火药、烟火药、引火线。
Fireworks and firecrackers仓库不得超过限定存量和品种储存，零售网点存放的Fireworks and firecrackers品种和数量不得超过当地安全生产Supervision and administration部门规定的数量。
Article 38 批发企业应当建立并严格执行采购、销售流向登记管理制度，健全购销档案，并留存2 years for review。
黑火药、烟火药、引火线批发企业的采购、销售记录应当在购买或者销售后Report to the local county (city, district) bureau for record within 3 days。
丢失黑火药、烟火药、引火线的企业应当立即向所在地县(municipal, district) work Safety Bureau and Public Security Bureau report。
Article 39 经营单位不得转让、买卖、出租、出借、冒用或者伪造经营许可证。
Article 40 有下列情形之一的，经营许可证颁发管理部门或者其上级安全生产Supervision and administration部门可以撤销其经营许可证：
(1) exceeding the right to issue business licenses。
(2) Issuing business licenses in violation of procedures。
(3) Issuance of business licenses without safety conditions。
Article 41 取得经营许可证的单位和个人终止Fireworks and firecrackers经营活动的，经营许可证颁发管理部门应当及时注销其经营许可证。
Article 42 Fireworks(批发)许可证》遗失、损毁的，应当立即书面报告省局，并在新闻媒体上登载遗失、损毁声明。自登载声明之日起一个月后，批发企业可向省局申请补发经营许可证。
Article 43 经营许可证颁发管理部门应当坚持公开、公平、公正的原则，严格依照法律、法规、规章和标准规定的条件及程序，审批、颁发经营许可证。
Article 44 安全评价机构应当科学、公正、依法地自主开展安全评价，并对评价结论负法律责任。安全评价报告存在错误或者缺陷的，经营许可证颁发管理部门应当责令评价公司进行整改；情节严重的，给予通报批评，并建议有关部门吊销其评价资质。
Article 45 经营许可证颁发管理部门应当定期向社会公布取得Fireworks and firecrackers经营许可证的单位名单。
Article 46 经营许可证颁发管理部门应当定期向社会公布取得Fireworks and firecrackers经营许可证制度。
Article 47 县The (municipal or district) bureau shall be established before March 1 of each year，将本行政区域内上年度Fireworks management(零售)许可证》的颁发情况报告省辖市局；省辖市局应当于每年3月10日前，将本行政区域内上年度Fireworks management(零售)许可证》的颁发情况报告省局。
Act 6 附则
Article 48 关于罚则，按照Fireworks management许可实施办法》Chapter Five的规定执行。
Article 49 Fireworks and firecrackers经营许可证按国家安全生产Supervision and administration总局规定式样，分正、副本，正、副本具有同等法律效力，正本为悬挂式，副本为折页式。
Article 50 Fireworks management(零售)许可证申请书》、Fireworks management(零售)许可证审查书》等文书由各省辖市局规定式样。
Article 51 The Provincial Bureau shall be responsible for the interpretation of these Rules。
Article 52 These Rules shall go into effect as of the date of promulgation。
